These Terms and Conditions govern all construction services provided by

1. Definitions

Client: Any individual or organisation engaging the Company

Company: Capital Construction Kent Ltd

Works: The construction services agreed between the Client and the Company

Contract: The agreement formed by acceptance of a quotation together with these Terms
-
Site: The location where the Works are carried out
2. Application of These Terms
These Terms apply to all contracts entered into by the Company.
No other terms shall apply unless agreed in writing by the Company.
By accepting a quotation or instructing the Company to proceed, the Client agrees to these Terms.
3. Quotations and Estimates

All quotations are valid for 30 days unless stated otherwise

Quotations are based on information provided by the Client

Prices exclude VAT, statutory fees, planning costs, and third-party charges unless stated
4. Scope of Works
The Company shall carry out the Works as described in the agreed quotation.
Any work outside the agreed scope shall be treated as a variation.
5. Variations
Any variations requested by the Client must be agreed in writing before commencement.
Variations may result in changes to the contract price and completion date.
6. Payment Terms

Payment terms are as stated in the quotation or invoice

Deposits are non-refundable once work has commenced or materials ordered

Invoices must be paid within [7 / 14 / 30] days

Late payments may incur interest at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998

The Company reserves the right to suspend works for overdue payments
7. Client Responsibilities
The Client shall:

Provide safe and uninterrupted access to the Site

Ensure the Site is free from hazards unrelated to the Works

Obtain all required permissions, including planning permission and building control approval, unless agreed otherwise
8. Timeframes and Delays
Any completion dates are estimates only.
The Company shall not be liable for delays caused by weather conditions, material shortages, variations, third-party actions, or events beyond its control.
9. Standards and Compliance
The Company shall carry out the Works with reasonable skill and care in accordance with:

UK Building Regulations

Applicable British Standards
-
Industry best practices
10. Materials
Materials supplied by the Company will be of reasonable quality and fit for purpose.
Any materials supplied by the Client are used at the Client’s own risk.
11. Defects and Warranty
The Company provides a [6 / 12] month workmanship warranty from the date of completion.
This warranty does not cover fair wear and tear, misuse, alterations by third parties, or manufacturer defects.
12. Health and Safety
The Company complies with all applicable health and safety legislation.
Clients must not interfere with safety procedures on Site.
13. Insurance
The Company maintains appropriate insurance, including:

Public Liability Insurance

Employer’s Liability Insurance
Proof of insurance is available upon request.
14. Limitation of Liability
The Company shall not be liable for indirect or consequential losses, including loss of profit or business.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
15. Termination
Either party may terminate the Contract if the other commits a serious breach.
Upon termination, payment remains due for all work completed and materials ordered up to the termination date.
16. Force Majeure
The Company shall not be liable for failure or delay in performance due to events beyond its reasonable control.
17. Intellectual Property
All drawings, plans, designs, and documentation remain the property of the Company unless agreed otherwise in writing.
18. Data Protection
The Company processes personal data in accordance with the UK GDPR and the Data Protection Act 2018.
19. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
20. Acceptance
By instructing the Company or accepting a quotation, the Client confirms acceptance of these Terms and Conditions.
